The terms for using this website, the Colocation Scout app for ChatGPT, and our sourcing service.

Agreement

These terms cover colocationscout.com, the Colocation Scout app for ChatGPT and other AI assistants, and any requirement you send us. Together we call these the "Service." By using the Service, you agree to these terms. If you do not agree, do not use the Service.

Colocation Scout is operated by Foretel Solutions, a Colorado company, and is powered by Bridgepointe Technologies. "We" and "us" mean Foretel Solutions.

What the Service is

Colocation Scout is a data center advisory and brokerage service. We help businesses find colocation and data center space. We compare options and ask operators about current capacity and pricing on your behalf.

The Service is for business use. It is not meant for consumers. You must be at least 18 and able to act for the business you represent.

Facility information is not an offer of space

The Service shows information about data center facilities. That includes locations, building sizes, build status and stated power figures. This information comes from our own research, operator websites, public filings and other sources. It can be incomplete or out of date.

  • A facility we show is not a claim that space or power is available there.
  • Power figures describe design or stated capability. They are not available capacity.
  • Match scores show how well known facts fit the needs you described. They are not a ranking of the best facility.
  • Blank or unknown values mean we do not know. They do not mean "no."

Current availability, specifications and terms must be confirmed with the operator. Our verification page explains what we check and what we do not.

Pricing ranges are not a quote

Regional cost ranges on the site and in the ChatGPT app are budgetary guidance based on actual quotes we have received. Posted list prices we show come from the operator's own website and link to it. Neither is a quote or offer for your requirement from any operator, and they do not bind us or any operator.

Real pricing depends on capacity, term, density, redundancy, configuration, timing and negotiation. It can differ a lot from any range we show. Only a written proposal from an operator sets a price.

Sending us a requirement

When you ask us to check availability or get pricing, you share business contact details and project requirements with us. You agree that we may contact you about that request. We describe a requirement to operators without naming you until you agree.

Please send only business information. Do not send passwords, payment card or bank account numbers, Social Security numbers or other government ID numbers.

We will work your request in good faith. We cannot promise that any operator will have capacity, will respond, or will offer particular terms.

How we are paid

Our service is free to tenants. An operator may pay us if you buy services through our sourcing process. We match facilities to the requirements you state, not to what we may be paid. Any contract for space or services is between you and the operator. We are not a party to it.

Acceptable use

You agree not to:

  • Scrape, bulk download or copy the facility data, or use the Service to build a competing dataset.
  • Send automated or excessive requests, or try to get around rate limits or other controls.
  • Send false requests, other people's contact details without permission, or unlawful content.
  • Interfere with the Service, probe it for weaknesses, or use it to break any law.

We may limit or stop access if we believe these terms are being broken.

Use through ChatGPT and other assistants

When you use our app inside ChatGPT or another AI assistant, that assistant's provider runs the conversation under its own terms and privacy policy. The assistant decides how to phrase our results. We are responsible only for the information our Service returns. If the assistant's wording differs from these terms, these terms and the data our Service returned control.

Our content

The Service, our facility data and our content belong to us or our licensors. You may use what you get from the Service for your own business evaluation. You may not resell it or republish it in bulk.

Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied. That includes warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. Market figures we cite belong to their publishers. They describe the period stated.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from the Service. Our total liability for any claim about the Service is limited to $100.

Indemnity

You agree to cover our reasonable losses and costs from claims that arise from your misuse of the Service or your breach of these terms.

Changes

We may update these terms. The date at the top shows the latest version. Using the Service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. The state and federal courts located in Colorado have exclusive jurisdiction over any dispute about the Service, unless the law requires otherwise.
